Job Description
POSITION TITLE: Manager, Ethics and Compliance Position #12847
The Ethics & Compliance Manager is responsible for investigating, managing and tracking ethics and compliance matters and interpreting trends. The Ethics & Compliance Manager supports the business in complying with key privacy and data protection requirements, including overseeing systems and case administration of consumer and team member data requests. The Ethics & Compliance Manager works with brands and functional teams to develop internal policies, procedures and training programs that further compliance efforts by using knowledge and information obtained from benchmarking, the identification of best practices and trends, and research and analysis of current and proposed regulations. He/she may also manage various special projects related to ethics and compliance.
ROLES AND RESPONSIBILITIES:
- Develop and maintain company compliance and regulatory policies, procedures, and controls
- Exercise judgment in managing inquiries and investigations on ethics and compliance matters
- Provide leadership on projects related to compliance with privacy and data protection requirements
- Develop training materials on key ethics and compliance concepts
- Manage internal compliance approval processes for conflicts of interest, gifts and entertainment, and related activities
- Maintain and update compliance policies and procedures in accordance with the Federal Sentencing Guidelines, SOX, Dodd-Frank, FDA, HIPAA and other applicable regulations
- Implement and review international partners and franchisees due diligence program
- Oversee enterprise-wide SOX procedures related to compliance and ethics, and work with Internal Audit and Finance, as needed, regarding SOX 404 related controls
- Conduct on-going research and analysis of compliance regulations, including food safety and nutrition, data privacy and anti-corruption guidelines
- Manage implementation of policies and procedures to ensure compliance and ethical behavior are understood, documented, addressed and treated as an essential part of each employee’s and partner’s responsibilities
- Implement and maintain an effective communication plan, including use of the compliance hotline, awareness of the Code of Conduct, and related policies and procedures
- Train employees, franchisees and other third parties, and track ethics and compliance education programs, including electronic based training
- Identify potential areas of compliance vulnerability and risk, and recommend remedial measures
- Resolve allegations of non-compliance with Code of Conduct, related policies, and regulations
- Manage internal investigations to ensure evidence preservation and compliance with privacy requirements
- Work with external advisors, as appropriate, to ensure independence and handling of allegations
- Recommend and monitor appropriate remedial measures, working collaborative with other functions
- Prepare update reports for senior management and Audit Committee
- Manage special projects
REQUIRED TECHNICAL SKILLS:
- Individuals should have 4-6 years of relevant experience
- Background in Compliance, Risk Management, Legal, or Internal Audit
- Prior experience conducting investigations, and ability to develop investigative questions in order to develop concepts, understand underlying facts, and obtain relevant information
- Project and program management experience, including leading cross-functional teams
- Strong analytical skills in reviewing current and proposed compliance regulations
- Ability to interpret data and identify trends, including statistical analysis
REQUIRED EDUCATION:
- Bachelor’s degree in legal studies, accounting, finance or a related field
OTHER KEY QUALIFICATIONS:
- Outstanding written and verbal communication skills
- Detailed oriented
PREFERRED SKILLS AND EXPERIENCE:
- Law Degree or Master’s Degree preferred
- Compliance certifications, such as CCEP or CIPP
- Training/teaching background
- Knowledge in assessing, designing, structuring and implementing compliance initiatives
- Experience in analyzing regulations, data and information
